1. Definitions

  • Consumer: Refers to an individual acting for purposes wholly or mainly outside of their trade, business, craft, or profession, as defined by the Consumer Rights Act 2015.

  • Services: The drainage services we provide, including unblocking, repairs, maintenance, and inspections.
  • Business Day: A day other than a Saturday, Sunday, or public holiday in England.

2. Scope of Services

We provide professional drainage services, including but not limited to:

  • Drain unblocking
  • CCTV drain surveys
  • Drain repairs and maintenance
  • Emergency drainage services

Services are available 24/7 in Kent and South East London, subject to availability and geographical limitations. Any exceptions or delays will be communicated in advance where possible.

3. Price and Payment

  • Quotation: Any price quoted is based on the initial information provided and may be subject to adjustment after an inspection. Quotes are valid for 7 days unless otherwise stated.
  • Price Adjustments: We reserve the right to adjust the price due to changes in material or labour costs, exchange rates, taxes, or unforeseen site conditions. Any such changes will be communicated, and a new quotation will be issued for Your approval.
  • Payment Terms: Payment is due upon completion of the services unless otherwise agreed. We accept payments by cash, debit card, credit card, or bank transfer. If payment is not made within the agreed terms, we reserve the right to charge interest on overdue sums in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
  • Receipts: Receipts for payment will be issued upon request.

4. Cancellations and Refunds

  • Cancellation Rights (Consumers): If You are a Consumer, you have the right to cancel a service contract made off-premises under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 within 14 days of booking the service.
    • If you request that services begin during this cancellation period, and later cancel, you will be liable to pay for any proportion of the services already performed.
    • Exceptions to cancellation rights apply to urgent repairs or maintenance services requested by You to begin immediately.
  • Cancellation Fees: Any cancellation made within 24 hours of a scheduled appointment may incur a cancellation fee to cover administrative costs and loss of business.

5. Warranties and Guarantees

  • Service Guarantee: We guarantee the workmanship of our drainage services for a period of 30 days from the date of completion. If the problem reoccurs due to the same issue, we will rectify it free of charge during this period.
  • Exclusions: This guarantee does not cover issues caused by misuse, external factors (e.g., tree roots or structural damage), or services requested outside the original scope of work.
  • Manufacturer Warranties: Any parts or materials supplied by third-party manufacturers are covered under the manufacturer's standard warranties.

6. Liability

  • Limitation of Liability: We will not be held liable for any indirect, incidental, or consequential losses (including loss of profit, business interruption, or reputational damage) arising from the provision of our services. Our liability is limited to the cost of the services provided, except in cases of death or personal injury caused by our negligence.
  • Consumer Protection: Nothing in these Terms excludes or limits your rights under the Consumer Rights Act 2015 or other relevant consumer protection laws.

7. Risk and Ownership

  • Risk: Risk of damage to or loss of any Goods provided by Us passes to You upon delivery or upon commencement of services at Your premises.
  • Ownership: Ownership of any Goods supplied will only pass to You once We have received full payment for the services and Goods.

8. Force Majeure

We shall not be liable for any failure to perform, or delay in performing, any of our obligations under these Terms where such failure or delay is due to events beyond our reasonable control (e.g., extreme weather, natural disasters, or unforeseen disruptions). In such cases, we will notify You as soon as possible and take reasonable steps to minimise delays.

9. Data Protection

We comply with the General Data Protection Regulation (GDPR) in handling and processing Your personal data. We reserve the right to terminate our contract with You if:

  • You fail to make payment for the services provided.
  • We encounter unsafe conditions or risks on Your property that prevent the safe delivery of services.
  • You breach any of these Terms.

13. Governing Law and Jurisdiction
